Power to dismiss application or refer to Commission
20.3If, on review of the application and any other information the Minister considers necessary, the Minister determines that
(a)
the application does not comply with the requirements set out in subsection 20.2(3) or it is not in the public interest to repeal or amend the by-law, as the case may be, the Minister shall dismiss the application, or
(b)
the application complies with the requirements set out in subsection 20.2(3) and it may be in the public interest to repeal or amend the by-law, as the case may be, the Minister shall direct the Local Governance Commission established under the
Local Governance Commission Act to conduct a study and provide a report of the matter.
